Terms of Service

These Terms of Service govern your access to CHILTAN's website and purchases from Chiltan Group LLC. By using the website or placing an order, you agree to these Terms and the Privacy, Shipping, and Refund Policies displayed by the store. If you do not agree, do not use the website or place an order.

Eligibility and authority

You must be legally capable of entering a binding contract. If you order for a company, contractor, property owner, or other person, you represent that you are authorized to bind that party.

Orders, acceptance, and cancellation

An order confirmation acknowledges receipt but does not require us to accept or fulfill an order. We may reject or cancel an order for inventory error, pricing error, suspected fraud, payment failure, delivery limitation, legal restriction, safety concern, quantity requirement, or other legitimate business reason. If we cancel after payment, we will refund the amount collected for the cancelled item or order.

Cancellation fee

If CHILTAN approves a customer-requested cancellation before processing, allocation, cutting, packing, tender to a carrier, or other fulfillment activity begins, CHILTAN may deduct a cancellation fee equal to 3% of the total order amount from the refund, where permitted by law. The fee does not apply when CHILTAN cancels the order or when a refund without that fee is required by applicable law.

Prices, taxes, and minimum quantities

Prices, availability, promotions, taxes, shipping, and fees may change before an order is accepted. The price shown in the cart and accepted order controls; descriptive text that contains an outdated price does not. Online checkout requires at least 10 panels total unless we approve a different arrangement in writing. You are responsible for taxes, permits, duties, and project costs not collected by us.

Product appearance and samples

Wall panels can vary in color, veining, pattern placement, sheen, texture, and production batch. Screens, lighting, photography, and installed-room images may not reproduce the physical product exactly and may include illustrative design examples. Request a physical sample when color or finish matching is important. The physical product and written specifications control over an on-screen impression. Order enough material from one batch for the complete project because later batch matching is not guaranteed.

Measurements, suitability, codes, and installation

You are responsible for measurements, quantities, waste allowance, substrate condition, adhesive and sealant selection, trims, expansion needs, ventilation, moisture management, fire and building-code requirements, permits, and suitability for the intended location. Decorative panels are not structural materials or a substitute for required waterproofing assemblies. Statements about moisture resistance depend on correct substrate preparation, sealing, installation, maintenance, and compliance with manufacturer instructions and local codes. Professional installation is recommended. Do not install material you believe is incorrect, damaged, or unsuitable.

Information and project guidance

Any estimate, design suggestion, quantity discussion, or installation guidance is general information unless included in a separate signed written agreement. You remain responsible for verification by a qualified contractor, designer, engineer, architect, code official, or other professional appropriate to the project.

Third-party services

Shopify, payment providers, carriers, installers, applications, and linked websites are independent third parties. Their services may be governed by separate terms. We are not responsible for third-party acts or omissions beyond the responsibility imposed on us by applicable law.

Returns, freight claims, and payment disputes

Returns and freight claims are governed by the Refund and Shipping Policies, including the 14-day return-request window, customer-paid return freight, condition requirements, and 20% restocking fee for eligible non-defective returns. Please contact us and allow a reasonable opportunity to investigate before initiating a payment dispute. We may provide order, authorization, communication, policy, and delivery records when responding to a dispute. Nothing here waives a legally protected dispute right.

Disclaimer of warranties

Except for any express written warranty provided with a product and any warranty that cannot lawfully be excluded, products and services are provided on an "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain exclusions, so this section applies only to the extent permitted.

Limitation of liability

To the fullest extent permitted by law, Chiltan Group LLC's total liability arising from a product or order will not exceed the amount paid to us for the affected product. We will not be liable for indirect, incidental, special, exemplary, consequential, labor, demolition, removal, reinstallation, project-delay, lost-profit, or business-interruption damages. These limits do not apply where prohibited by law, including liability that cannot be limited for personal injury, fraud, gross negligence, willful misconduct, or mandatory consumer rights.

Indemnity

To the extent permitted by law, you agree to indemnify Chiltan Group LLC from third-party claims and reasonable costs caused by your unlawful use, material breach of these Terms, unauthorized modification, improper installation, or misuse of a product. This does not require a consumer to indemnify us for our own unlawful conduct.

Governing law and venue

Texas law governs these Terms without regard to conflict-of-law principles. Subject to mandatory consumer rights and any court with required jurisdiction, disputes will be brought in state or federal courts located in Tarrant County, Texas. This provision does not remove a right to use an eligible small-claims court or another forum that applicable law makes non-waivable.

Changes and severability

We may update these Terms prospectively by posting a revised effective date. The version accepted with an order governs that order. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.
