Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CHILTAN website and your purchase of products from Chiltan Group LLC d/b/a CHILTAN (“CHILTAN,” “we,” “us,” or “our”). By using the site or submitting an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the site.

Eligibility and acceptable use

You must be legally capable of entering a binding contract and provide current, complete, and accurate information. You may not misuse the site, violate law or third-party rights, introduce malicious code, scrape or interfere with the service, circumvent security, or use our content or products for unlawful purposes. We may suspend or terminate access for misuse.

Products, images, and suitability

Product photographs, renders, measurements, colors, veining, patterns, texture, gloss, and other visual details are illustrative and may vary because of screens, lighting, photography, manufacturing, and production batches. Ordinary variation is not a defect. Unless expressly stated, accessories, trim, adhesive, tools, installation, and pictured surroundings are not included. You are responsible for checking specifications, measuring, ordering enough material from one batch, allowing for waste, confirming suitability for the intended location, and complying with building, fire, plumbing, electrical, and other applicable codes.

Descriptions such as moisture-resistant, waterproof, or suitable for a room describe the product only under the stated conditions and do not guarantee a watertight assembly. Seams, edges, penetrations, substrates, adhesives, ventilation, installation, and maintenance affect performance. Use qualified professionals where appropriate and follow product and manufacturer instructions.

Prices and order acceptance

Prices, availability, promotions, specifications, and minimum quantities may change without notice. Taxes, shipping, delivery, freight, lift-gate, residential, redelivery, accessorial, and other charges may be added where disclosed. Website display and an order confirmation are acknowledgments, not acceptance. We may accept, reject, cancel, limit, or condition any order before shipment or pickup for reasons including inventory, pricing or description errors, suspected fraud, payment issues, shipping limitations, minimum quantities, or legal restrictions. If we cancel after collecting payment, we will refund the canceled amount.

We may correct typographical, pricing, inventory, and other errors and update information at any time. If a material correction affects a submitted but unfulfilled order, we may offer the corrected terms or cancel and refund the affected item.

Payment and fraud prevention

You authorize us and our payment providers to charge all amounts shown at checkout. You represent that you are authorized to use the payment method and that billing and shipping information is accurate. We may require verification, place fulfillment on hold, limit quantities, or cancel suspected fraudulent or unauthorized transactions.

Shipping, delivery, title, and risk

Shipping and delivery are governed by our Shipping Policy. Dates are estimates unless we expressly provide a legally binding commitment. Delays may occur because of carriers, weather, supply, access, inspection, force majeure, or other circumstances. Inspect freight before accepting it and follow the damage-reporting process in our policies. Title and risk of loss transfer as provided by applicable law and the selected delivery terms; nothing here changes rights that cannot be waived.

Returns and cancellations

Returns, refunds, restocking fees, return freight, inspection, non-returnable items, and cancellations are governed by our Return and Refund Policy. Approved eligible returns are generally subject to a 20% restocking fee and customer-paid return shipping, as conspicuously disclosed there, except where prohibited by law or where CHILTAN is responsible for a verified incorrect or defective item.

Cancellation fee. If CHILTAN approves a customer-requested cancellation before processing, allocation, cutting, packing, tender to a carrier, or other fulfillment activity begins, CHILTAN may deduct a cancellation fee equal to 3% of the total order amount from the refund, where permitted by law. The fee does not apply when CHILTAN cancels the order or when a refund without that fee is required by applicable law.

Installation and property conditions

Except where expressly agreed in a separate signed writing, CHILTAN sells materials and does not inspect, design, engineer, prepare, or install your project. You and your installer are responsible for substrate condition, moisture management, expansion, adhesion, fastening, sealing, clearance, code compliance, workplace safety, and compatibility with other materials. Do not cut or install any product before inspecting and approving it. Installation constitutes acceptance of visible characteristics to the fullest extent permitted by law.

Intellectual property

The site and its text, graphics, logos, images, video, design, software, and compilation are owned by or licensed to CHILTAN and protected by applicable intellectual-property laws. We grant only a limited, revocable, non-transferable license for personal shopping use. No content may be copied, republished, sold, or commercially exploited without written permission, except as allowed by law.

Third-party services and links

The site may use or link to Shopify, payment processors, carriers, social networks, apps, and other third parties. Their services are governed by their own terms and policies. To the extent permitted by law, CHILTAN is not responsible for independent third-party content, acts, outages, or services.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY THAT ACCOMPANIES A PRODUCT. WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHILTAN AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, OR LOSS OF USE ARISING FROM THE SITE, PRODUCTS, SHIPPING, OR INSTALLATION. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID CHILTAN FOR THE PRODUCT GIVING RISE TO THAT CLAIM. These limits do not apply where prohibited or to liability that cannot lawfully be limited.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold CHILTAN harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the site, violation of these Terms, infringement of third-party rights, or improper installation or use of products, except to the extent caused by CHILTAN’s own conduct.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where the law of your residence provides non-waivable protections. Any court proceeding shall be brought in a court of competent jurisdiction in Tarrant County, Texas, unless applicable law requires another venue. Before filing a claim, the parties should make a good-faith effort to resolve it informally by written notice. Nothing here limits access to small-claims court or any non-waivable consumer remedy.

Changes, severability, and entire agreement

We may update these Terms prospectively by posting a revised effective date. The version in effect when you place an order generally governs that order. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. These Terms and incorporated policies form the entire agreement for website purchases except for a separate signed writing.
